1. In these terms and conditions "we", "us" "our and "Website" means Bid 2 Win Pty Ltd, ACN 141 527 657, P O Box7393 Cloister Square, Perth 6850. Please read these terms and conditions carefully as they apply to your use of this website at http://bid2win.com.au (the "Website"), by using this website or becoming a member of this website you agree to be bound by these terms and conditions.
2. We may revise these terms and conditions from time to time. We will publish a notice on this Website alerting you when any such revisions have been made, this will be under the News title on the site. If you continue to use this website after we have published such a notice, you agree to be bound by those revisions. If you do not agree to those revisions, you may cancel your membership by contacting us at admin@bid2win.com.au in which case we will refund to you any unused bids in your account.
3. You must be a registered member of this Website to take part in the auctions conducted on this Website. Membership of this Website is subject to the following terms and conditions:
(a) Membership of this Website is only open to individuals aged 18 years or older. By joining this Website, you undertake that you are at least 18 years of age;
(b) Membership of this Website is not open to Bid 2 Win employees or their immediate family members;
(c) Membership of this Website is only open to individuals for their own personal use. Membership is not open for commercial purposes, including retailers;
(d) Membership of this Website is only open to residents of Australia. Products won by auction will only be supplied to members who provide a local address for their credit card, Paypal account and a local delivery address in Australia;
(e) An individual may only register one membership; Bid 2 Win reserves the right to restrict the number of accounts per user and/or IP address, physical address, e-mail address etc; to only 1 account.
(f) Membership is not transferable. You must not allow others to use your membership and you must not transfer or sell your membership to another person. You must maintain control of your member name and password and are responsible for any action taken while logged in as a member. You agree to notify us immediately if you become aware of any unauthorised or improper use or disclosure of your member name and password, in which case we will issue you with a new member name and password and;
(g) You must not choose a member name that is in any indecent, insulting or intended to deceive or mislead other users or a member name that advertises other websites or goods or services.
(h) The auctions run on this Website enable members to place bids on auctions for different products. In order to place a bid on an auction a member must pay a fee for each bid. The fee charged depends upon the package that the member purchases. The fee may be varied by us from time to time. Fees must be paid by you in advance by using our "purchase package" facility. Any variation to our bid fees will not apply to any unused bids you have purchased in advance. Bid packages are not refundable.
(i) Members are to read the Start, Help and Responsible Bidding pages as these are also part of our Terms & Conditions, by checking the "I have read the Terms & Conditions" when you open your account indicates that you have read all pages.
(j) These terms and conditions apply in the same way whether you place bids manually or by using the Auto Bid facility.
(k) Each bid placed will increase the price of the product by a pre-set amount. Each new bid increases the remaining time for an auction (usually between 5 seconds and 30 seconds). When a bid is placed it uses one bid which is deducted from the member's bidding account.
(l) An auction closes when no more bids are received by Bid2win's servers. The countdown timer is indicated on each auction. Occassionally when multiple bids are received by the server at the same time there may be a auction closed caption come up when you try to place a bid, please refresh your screen and look for the auction down the page as multiple bids would of added additional time to the auction and caused it to move further down the page, alternatively do not wait till the last second to place to your bid if there is any delay with your connection it may not be received by our server in time and as time will be added to the auction time (between 5 and 30 seconds) there is really no benefit in waiting till the last second and perhaps missing out on the auction yourself.
(m) There may be at times a slight delay in displaying the latest information this is largely due to your machine receiving the information from our server and this information is not delivered to your machine 'instantaneously therefore only the timer maintained on our servers is taken into account to decide which bids are valid and when the auction ends. The timer on your machine should therefore only be viewed as an indication of the auction time. During Peak times the timers sometimes sit for a moment not moving this is due to the server processing all the bids which have come in.
(n) Bids become valid when they are entered into our database and registered on our system. We can not be held responsible for disruptions or errors that arise from your internet connection or other causes beyond our reasonable control. This includes incorrect countdown of the remaining time and outdated information on bidders and bids;
4 (a) We reserve the right to pause any and all auctions, change the bidding time of ongoing auctions and open closed auctions if there is a disruption in our operations;
(b) You must not engage in fraud, manipulation of the auction including collusion with any other members to manipulate the outcome of the auction or by any means whatsoever;
(c) We, Bid2win cannot be held responsible for users and auctions being affected by other users abusing the sign up system and the free bid(s) which we offer from time to time.
(d) While we endeavour to avoid technical and other errors, sometimes errors do occur from time to time which are beyond our control under these circumstances we reserve the right to decline an auction that our system has accepted a bid on, in such circumstances we will refund to you all bids placed in that auction, and any price you have paid to us for the relevant Merchandise, we will also provide you with complimentary bids for the inconvenience, the number of these will vary depending upon the item that was being auctioned when the technical error occurred.
5. If you fail to pay for any auction you have won or we reasonably believe that you have breached these terms and conditions in any way whatsoever we may:
(a) Revoke any winning bid that you have made, if we do so we will refund to you the fee for the winning bid only and will award the auction to the member who placed the bid before yours.
(b) we may suspend, terminate or restrict your membership if you have breached any of these terms and conditions and you must not apply for a new membership.
(c) If you are the winning bidder in an auction you must pay for the auction within 7 days of the auction closing or notify us within 7 days of the auction closing at admin@bid2win.com.au to request for an extension otherwise condition (a) will apply
6. Our Listed Recommended Retail Price (RRP)/ Delivery, title and risk/ Our returns policy
(a) The listed RRP of the products on this Website is based on the listed RRP of our suppliers and/or Manufacturer's RRP, and it is our listed RRP only that our Guarantee will apply to regardless if a corresponding product is available elsewhere at the same time on sale.
(b) We will endeavour to have the product delivered to you within 14 working days from receipt of payment for the auction. However, unforseen supply problems or unexpected demand on a product may occasionally result in the product being either temporarly unavailable or unavailable for an unreasonable amount of time. In these instances we will contact you as soon as possible to advise you of the reason for the delay. If this occurs we may offer to supply you with a similar or superior product that we can obtain at no additional charge to you or you may choose to wait. If you decide that you cannot wait and would like to be refunded then this can be organised, you will be refunded the final amount of the auction price/discounted price that you paid as well as 1 bid credit for the winning bid made, the other bids made on the auction are not refundable.
(c) We will deliver the product to the place of delivery within Australia that you specify. You may not specify a delivery address outside of Australia. Title to and risk in the Product will pass to you upon delivery of the product to your specified place of delivery.
(d) Once final payment of the auction has been made and received we will organise for the delivery of your item.
(e) Delivery charges are currently free within Australia and we reserve the right to change this at any time in the future. Items are usually shipped within 7 business and delivery within 7 business days after your item has been despatched.
(f) All products are supplied and shipped within Australia so there are no additional taxes of import duties applicable.
(g) Currently we only ship to Australia, if you are purchasing an item that you would like to ship overseas then you need to supply us with your Australian address, when you receive your product you can then decide to open it and check that it is not DOA before shipping it to it's final destination, you may choose to ship it directly to it's final destination but it will be out of Bid2win.com.au DOA policy but it will still be covered by the manufacturer's guarantee.
